4. Alternative Dispute Resolution (ADR)
In accordance with Law No. 144/2015, ADEGA ALGARVIA and TATIANA ABRANTES - ARTE UNIPESSOAL, LDA recognize the importance of offering consumers a pathway to resolve disputes outside of the court system. Consumers have the option to submit disputes to an Alternative Dispute Resolution (ADR) process. This law transposes Directive 2013/11/EU of the European Parliament and of the Council into Portuguese law and provides mechanisms for a quicker and more efficient resolution of consumer disputes.
What is ADR?
ADR refers to methods such as mediation, conciliation, and arbitration, which aim to settle disputes outside of the traditional court system. The process begins with mediation or conciliation, and if an agreement is not reached, the dispute can proceed to arbitration.
Available ADR Organizations:
ADR organizations are independent entities that specialize in helping both consumers and businesses find amicable solutions. These organisations are authorized to mediate, conciliate, and arbitrate disputes and are registered with the Directorate-General for Consumer Affairs. There are several centres in Portugal, including regional centres in Lisbon, Porto, Coimbra, Guimarães, Braga/Vianna do Castelo, the Algarve, Madeira, and the national centre, CNIACC - Centro Nacional de Informação e Arbitragem de Conflitos de Consumo.
How to Use ADR:
If you wish to resolve a dispute through ADR, you are free to choose one of the registered centres. The centre with jurisdiction will generally be determined by the location where the contract for goods or services was concluded.
Our Commitment to ADR:
As a business providing goods and services, ADEGA ALGARVIA is committed to informing customers about available ADR organisations. This information is provided through our website and in our terms of sale. We encourage you to contact us should you wish to explore this option before taking legal action.
Obligation to Inform:
ADEGA ALGARVIA is legally required to inform consumers about the possibility of ADR, in line with Law No. 144/2015. Failure to provide this information could result in fines imposed by the Food and Economic Safety Authority (ASAE) or sectoral regulators.
For further information about ADR options, you can reach us at info@adegaalgarvia.com.
